Check-in Procedures
One of the first things a new tenant should do upon entering his or her apartment is a thorough Inspection of the premises. Each tenant is given an apartment “Condition Sheet” at the time a lease is signed and keys are issued. This sheet should be completed and returned to the Apartment Office within five (5) working days of the date of occupancy.
This condition or inspection sheet is designed for the protection of the tenant. Damages to the apartment from previous tenants will not be billed to current tenants if the form indicates prior damage. If assistance is needed in completing the sheet, please contact the Apartment Manager at 293-5840. Failure to complete and submit the check-in sheet may result in inappropriate charges to you.
BackHousekeeping Services
Each apartment complex is serviced by a campus service worker. The campus service worker’s primary duties include keeping the public areas of the building clean and in good repair.
BackRepairs and Maintenance
The University expects each tenant to treat an apartment with care and respect. No charge will be assessed for normal wear. Tenants are held responsible for any damages or abuse to University property. In signing a University lease, the tenant acknowledges the right of the University to inspect the apartment; that mistreatment, neglect, or abuse of State property will result in immediate cancellation of a lease and/or eviction of the tenant without further notice.
- The tenant agrees that the University has the right to enter the tenant’s apartment to examine it or to make repairs, additions, alterations or any service as deemed necessary for the preservation of the apartment or the building. The department makes every attempt to provide good living conditions which include changing the filters in the air conditioners in early spring. The tenant agrees that the Apartment Manager or the Pest Control specialist has the right to make periodic inspections.
- The tenant should report needed repairs to the Apartment Office or to the website http://fsd.wvu.edu as soon as possible. If repairs, service or painting are required due to a tenant’s carelessness or negligence, the tenant must bear the cost. This will include such items as a drain or toilet that is clogged or a garbage disposal that has been damaged by a foreign object abuse. Tenants are jointly and severally responsible for damages.
- Prompt maintenance service is the goal of the department. In order to achieve this goal, we need your cooperation. The Apartment Manager is available at 293-5840 8:15 a.m. to 4:45 p.m. Monday through Friday. If emergency problems occur after office hours, you may call 293-3136. When calling, you must give your name, apartment number and the maintenance problem. Only emergency maintenance problems should be reported to DPS and all routine maintenance problems will be handled through the Apartment Manager’s Office. The apartments have one assistant who is available in the even- ings and on weekends for lockouts.
Pest Management Program
The Department of Housing and University Apartments is dedicated to providing a pest-free environment. We have implemented a comprehensive pest control management program which has proven very successful. Prior to occupancy, extensive work is completed in each apartment. Additionally, each apartment will be inspected for pests monthly and treated comprehensively once a year in June.
The chemicals used in these treatments are approved by the Environmental Protections Agency (EPA) and applied by licensed technicians only. As an extra precaution, the University does place restrictions involving certain groups. The restrictions apply to women in their seventh, eighth, and ninth month of pregnancy and infants that are six months old or younger. When the Pest Control Specialist enters the apartment, those individuals are required to leave for a minimum of four hours.
No special preparation is needed for the monthly inspection. The specialist will determine if future treatments are necessary. Tenants are responsible for maintaining their apartments in accordance with acceptable sanitation and safety standards. Any violation of these standards and any conditions conductive to pest activity will be reported to the Apartment Manager’s office. Failure to correct these conditions will be considered a breach of contract and will result in termination of the lease.
Special preparation is required for comprehensive pesticide treatment in June.
- Empty all kitchen cabinets and closets and place all items on your kitchen table or floor. Cover the items with paper or cloth.
- Place all open food in your refrigerator.
- Remove all items from counter tops and cover them.
- Bathroom floors should be cleared and items removed from the toiler top, tub and sink. These items can be placed in your bedrooms.
- Upon returning to your apartment, please wipe off kitchen counter tops and stove top before returning any items to them. Remember, you must wait, at least, four (4) hours after the pesticide treatment to enter your apartment
Each apartment will receive ample written notice of scheduled comprehensive treatment of each building. Notices will also be posted on bulletin boards in the public areas of each apartment complex.
We regret the inconvenience this may cause you, but in order for the treatment to be effective, all of the above preparations must be done. The apartment lease is subject to termination if a tenant fails to comply with the pest control treatment program, including the special preparation.
If you experience a problem with household pests, please contact the Pest Control Specialist at 293-4419. Additional treatment is available weekly for individual apartments and rooms upon request.
BackTerms of Occupancy
A. Persons in the following categories are eligible to apply for housing in University-owned apartments with priorities as listed:
Faculty Apts: faculty, visiting professors, lecturers, professional staff desiring temporary housing only with a maximum occupancy of two years.
Medical Center Apts: graduate students, faculty, staff, undergraduate students (age 21 or older). One pre-school child may be included in the one-bedroom apartments only.
It is the policy of West Virginia University to provide equal opportunities to all prospective and current students, faculty and staff on the basis of individual qualifications without regard to race, color, national origin, religion, sex, sexual orientation, veteran status, age or handicap. The University neither affiliates knowingly with nor grants recognition to any individual, group or organization having policies that discriminate as defined by applicable laws and regulations.
B. At the time a new tenant signs a lease a security deposit equal to one month’s rent plus first month’s rent must be paid. Payment must be made before the tenant is issued apartment keys
C. Rent is due without notice the first day of each month. If the tenant has a past due balance, a late fee may be assessed according to WVU policy. A tenant who is delinquent in rent payments may be subject to cancellation of his/her lease and subsequent eviction. In addition, student records will be placed on hold at Admissions and Records until the account is cleared.
D. Rent starts the day specified on the lease or the day tenant takes possession, whichever is earlier. Rent terminates the day the lease ends or the day the apartment is vacated, whichever is later. The apartment will not be considered vacated until apartment keys are returned. If the tenant vacates an apartment that is damaged or needs cleaning, he/she will be responsible for any resulting charges, which will be deducted from the security deposit. A tenant must submit a vacating notice in writing at least thirty (30) days prior to moving.
E. The tenant agrees not to assign, sublet or transfer possessionof his/her apartment or any part thereof, without prior approval of the University. If the tenant acquires a roommate, the University must be notified within three working days. The roommate must come to the Apartment Office and sign an apartment lease. In doing so, he/she also assumes responsibility for rent payments and the current condition of the apartment. The same terms of eligibility and obligation apply to the roommate as to the leaseholder.
F. Loud parties or activities which will in any manner disturb annoy or cause discomfort to other residents is not permitted. Tenants are held responsible for the conduct of their guests. Breach of this regulation is cause for immediate cancellation of the lease.
G. The tenant may not paint, paper or alter the apartment or any part thereof without prior written approval of the Apartment Manager. Nails, tacks or adhesives of any kind are not to be used on doors, walls or other areas in the apartment. University equipment must not be removed from an apartment or the building without approval of the Apartment Manager. Questions regarding this matter should be directed to the Apartment Manager at 293-5840.
H. Tenants must use only those picture hooks and other fasteners approved by the University and must not remove them upon vacating the apartment. If the apartment is equipped with picture molding, no other method of attaching pictures or objects to walls will be approved. If the tenant wants heavy objects fastened to the walls, he/she must make a special request. The University will make the installation and a reasonable charge will be assessed the tenant.
I. Erecting or installing antennas, awnings, clotheslines and attaching clothesline fasteners to the exterior of the building is prohibited.
J. No tenant-owned major appliances such as washers, dryers, dishwashers or freezers may be installed. In addition, there are other furnishings that are neither safe, nor desirable in University apartments such as Halogen lamps. Because an item is not explicitly excluded does not mean that it is permissible. The safest practice is to contact the Apartment Manager for a ruling if there is any doubt at all. Large appliances are not allowed due to electric service capacity of 60 amps.
K. For health and safety reasons, dogs, cats, birds, snakes and all other animals or pets are prohibited from University-owned apartments. Tenants are permitted one fish tank, not to exceed 10 gallon.
L. Dangerous drugs and narcotics, as defined and prohibited by State and Federal laws and statutes, are prohibited in the apartment and buildings.
M. The University has made no representations or promises with respect to apartments or any part of the premises other than those set forth in this document, which is a part of the lease agreement. No modification of this agreement will be made except in writing bearing the signature of the University representative and the tenant.
N. The amount of rent is subject to change with sixty (60) days prior notice.
O. Possession or use of firearms, weapons (BB Guns, included), fireworks, gasoline, flammable liquids, explosives, volatile chemicals or other materials which endanger the health, safety and welfare of human/animal life is prohibited.
P. Tampering with or misuse of fire-alarm systems, fire-fighting equipment and building security systems is extremely dangerous, illegal and prohibited. Violators will be prosecuted to the full extent of the law, which may include both a fine and a prison sentence. A tenant(s) engaging in such activity is also subject to immediate removal from the apartment and suspension from the University.
Q. The University apartments are operated for the appropriate use of University students, faculty, staff (who have properly leased an apartment through the Apartment Office), immediate family members and overnight guests. All occupants of an apartment must be listed on the Tenant Registry on file in the Apartment Office. Tenants exceeding the designated limit of occupants for an apartment and/or failing to list all apartment occupants on the registry are subject to eviction. University identification may be required at any time. If you have questions regarding the allowable number of occupants for an apartment complex or similar questions, you should contact the Operations Manager at 293-5840.
R. The conduction of any business or commercial enterprise for personal profit is prohibited in University-owned housing. In accordance with the West Virginia Board of Governors policy, no one is permitted to use rooms, buildings or adjacent grounds for commercial purposes. Such enterprises may be conducted only by recognized student activities and student governments within the residential area subject to prior University approval.
S. Gambling is forbidden on University property.
T. Waterbeds and other liquid-filled furnishings are prohibited.
U. Washing of cars on the premises is not permitted.
V. It is the responsibility of parent(s) to supervise children in the play area’s grounds and to report any unsafe condition that may exist.
BackTermination of Lease
A. A lease will be terminated when a tenant ceases to be a full-time member of the University student body, faculty or staff. Part-time students completing graduate studies may remain in University Housing with proof from the Dean of the College that the student is continuing with graduate work which will result in graduation. Tenants are required to provide a written thirty (30) day advance notice of intent to vacate. Proof of withdrawal, graduation, or termination of University employment must be submitted if a tenant plans to vacate prior to the expiration of his/her apartment lease.
B. A lease may be terminated by the University in the event the tenant has misrepresented any material fact on the application or any other statement submitted for housing; if the tenant becomes delinquent in rent payments; or if the tenant has breached any other conditions of the lease. In such cases, the tenant waives all other notice required by the law to terminate the lease and gives the University the right to enter the premises immediately and to evict the tenant.
C. Only married students (with or without children), single student parents with children, students of the same sex, brother and sister, or student and parent may share the same apartment. If it is learned that individuals of the opposite sex who do not meet these qualifications are occupying the same apartment, the University has the right to terminate the contract of the leaseholder without advance notice and to cause the tenant to move from the apartment immediately. Cohabitation is a misdemeanor under West Virginia state code Article 8 chapter 61.
D. If it is deemed necessary to pursue eviction through the judicial process, such action will be initiated in Magistrate Court.
BackNon-Liability
A. All notices to the tenant will be sufficient if delivered in person, mailed to his/her address or posted on the bulletin boards in the apartment buildings. All notices to the University must be in writing and delivered or mailed to the Department of University Housing and Apartments.
B. The University assumes no liability for the loss, damage or theft of any of the tenant’s personal property resulting from explosion, fire, mechanical failure, water, steam, gas line breaks or from any defective wiring; for loss or damage resulting from the negligence of any other residents of the building; for loss or damage resulting from the negligence of its employees or any other cause. It is suggested that proper insurance be obtained by the tenant to protect himself, his/her family and personal property.
C. Property abandoned in both an apartment, or on University premises will be disposed of at the discretion of the Department of University Housing and Apartments. The University assumes no responsibility for the loss, damage or theft of any personal items. It is the obligation of the tenant to ensure that all of his/her belongings are removed from University premises at the time of departure.
D. The University will not be responsible for failure to supply water, electricity, gas, cable TV, or any utility for any cause whatsoever; nor will the tenant be entitled to any rent refund for temporary interruption of services.
BackCheck-Out Procedures
A. It is the responsibility of each tenant to arrange a check-out appointment with the Operations Manager. This appointment should be scheduled at least three (3) days prior to check-out. Check-out is not considered complete until all keys have been returned. If tenant(s) fail to return all keys issued to him/her within two (2) working days of vacating date, lock changes will be initiated and the tenant(s) will be charged a fee.
B. When a tenant is ready to move out of an apartment, he/she is required to leave the apartment in the same condition as it was at the time of initial occupancy barring normal wear and tear. The apartment must be free of the tenant’s personal possessions and the woodwork, walls, cabinets, closets, plumbing fixtures, range and floors must be clean. The refrigerator must be defrosted, cleaned, and turned off. Any damages and/or cleaning necessary in the apartment will be the financial responsibility of the tenant.
BackTransfer Policy
If the primary leaseholder/roommate desires to relocate from one apartment to another, the move must be approved and he/she must adhere to the following procedures:
1. The apartment currently occupied by the tenant(s) must be checked by the Operations Manager prior to approval.
2. The apartment currently occupied must be cleaned and in acceptable condition to rent before the transfer will be granted.
3. Approval for transfer will be given based on (1 & 2) and if a suitable apartment is available and the tenant requesting the transfer is in good financial standing with the Department of University Housing and Apartments.
4. All conditions set forth in the check-out procedures must be met; a new lease must be signed and an adjustment made in the security deposit.
5. A transfer fee must be paid by the tenant(s) requesting the transfer. This charge is assessed because of the added expense in record-keeping and the temporary loss of rent from the apartment involved in transfer.
6. Any cleaning or maintenance charges not considered normal wear, involving the transferring apartment will be assessed in addition to the transfer fee.
BackApartment Key Policy
The issuance and control of keys and locks is an important aspect of the service provided to University apartment tenants. The University Housing and Apartments Office will make every effort to ensure that apartments are provided with quality keys and locks that provide safety and security for residents. Tenants have a responsibility to comply with these policies to preclude a breach of security measures.
All tenants should exercise extreme caution in safeguarding their keys. When not in the apartment, tenants should keep doors locked. The University is not responsible for damage or loss of personal belongings. It is strongly advised that tenants secure personal insurance to protect items in case of theft, fire or other incidents.
The tenant(s) agrees too accept responsibility for all costs involved with lock changes and re-issuance of keys.
- At the time of check-in, tenants will be given two keys for the apartment; one mail box key and one cubicle if applicable. The tenant is, thereafter, responsible for the safekeeping of all keys until they are returned to the Apartment Office. If more than two keys are needed, extra keys may be requested and made for a nominal charge. Tenants are not authorized to duplicate any keys.
- If a key is lost, the tenant must report the loss immediately to the Apartment Office. A replacement key will be provided for a period of five (5) days. If the original key is found, the tenant should notify the Apartment office immediately and return the replacement key. If the original key is not found and/or the replacement key is not returned within the five (5) day period a work order will be initiated for a lock change and new keys will be issued to the tenant. The tenant(s) will be billed for any cost incurred.
- If a tenant has difficulty in using an apartment lock or key, he/she should report this problem to the Apartment Manager as soon as possible. If deemed necessary, a work order will be issued and lock or key repair will be made as quickly as possible.
- In the event that a tenant finds that he/she is locked out of the apartment during regular working hours, the Operations Manager may be contacted at 293-5840. After regular work hours (evenings & weekends), the tenant should contact the Department of Public Safety (DPS) at 293-3136, who will contact a maintenance worker to lend assistance. University staff responding to such a call will be required to check identification before granting access to the apartment. If the individual is not registered with the Department of University Housing and Apartments, he/she will not be allowed access to the apartment. Tenants will be charged a lockout fee for this service.
- When a tenant vacates an apartment, all keys must be returned within two working days of the vacating date or he/she will be billed for necessary lock changes and for costs involved in making new keys. Until all keys are returned, check-out is considered incomplete; therefore, the tenant remains responsible for the apartment rent and all furnishings.
Laundry
Facilities for washing and drying are available for residents in each building. These facilities are contracted by a private vendor. Any mechanical problems or lost money should be reported to Caldwell and Gregory. Dial 1 800-927-9274 for refunds or repairs. Washers and dryers are coin operated and should be used at tenant’s risk.
University laundry facilities are to be used by apartment tenants only. Non-residents using the facilities are trespassing on University property and are subject to arrest. We ask for your cooperation in deterring unauthorized persons from using the facilities. If unauthorized persons are seen using laundry facilities, tenants are encouraged to call the Department of Public Safety (DPS) at 293-3136. Individuals calling will be required to give their names and building location.
BackTelephone Service
Telephone Service is provided in all University apartments. All telephones have individually assigned numbers. The first three digits (293) identify the phone as part of the University Centrex/ESSX-1 System. Intercommunication among telephones on the campus system is made by dialing 3 plus the last four digits. Off campus calls can be made by dialing (9) and then the seven-digit local number. To dial a toll free number you must dial (9) and then (1) before dialing the 800 number.
- ECCI is the University long distance provider, and a tenant may obtain a PSC for an account. When a tenant signs up for the service, he/she is issued a 9-digit personal security code. This code is the only one that should be used in an apartment. To set up a long distance account you can call ECCI at their toll free number 1800-YES-ECCI. You can register on line at www.campusecci.com
- The use of a faculty or staff T.I.D. number is prohibited . No collect telephone calls may be accepted by a tenant. An administrative tracking fee will be assessed on any unauthorized long-distance bill traced to an apartment. No calls may be charged to a WVU telephone number; only ECCI or credit card accounts are acceptable. Telephone numbers are assigned by apartment rather than by occupant so if a tenant changes apartments, the telephone number will also change. It is the responsibility of the tenant to terminate long-distance service with ECCI at the time of check-out.
Fire/Bomb Threat Emergency
All persons in apartments are required to leave the building when there is a fire alarm or when notified by University staff of a bomb threat. Turning in false fire alarms or reporting false bomb threats is prohibited by law. Any person found violating this law will be reported to the proper authorities for prosecution.
According to state law, tenants are prohibited from tampering with fire extinguishers or other fire equipment. State law required that extinguishers always be in condition for use. If a fire is detected, the following procedures should be followed.
1. Set off the nearest alarm.
2. Call 9-911 and say “I want to report a fire at (give the address).”
3. Leave the building by the exit on your floor. Do not use the elevator.
4. Before leaving your room when the alarm goes off.
- Turn off the overhead lights.
- Close the windows.
- Put on shoes (not bedroom slippers).
- Carry a large towel for head and face protection against flames and smoke.
5. Walk calmly to the exterior of the building by your assigned exit.
6. Be sure the stairway door is closed behind you if no other residents are following.
7. Do not return to the building until the signal is given by a University staff member in charge.
Treat a fire alarm as though a serious condition exists. Tenants will have no indication whether it is real or a drill. In an emergency such as fire, all residents must remain far enough away from the building to allow the emergency workers to do their jobs. Please gather near the emergency assembly area designated in front of the apartment complex. The fire chief or other trained professional in charge will inform tenants when they may return to their apartments.
If a tenant detects a minor fire, he/she may try to put it out with the nearest fire extinguisher; however, the procedure described earlier must still be followed—call 9-911 immediately so that a professional can check to make sure the fire is out and will not reoccur and so that the fire extinguisher can be refilled promptly.
False alarms are taken seriously by University officials. Persons found guilty of setting off a false alarm or tampering with fire/life safety equipment or building security systems are subject to removal from the University and prosecution to the full extent of the law.
BackParking
In order to provide a fair distribution of parking spaces for apartment tenants, control of the parking lots must be maintained. Department policies in regard to control are:
A. A tenant may park no more than one vehicle in the parking lot of the parking lot of the complex in which he/she lives. Parking is for cars with valid parking decals. Parking is not guaranteed and is first come first serve.
B. Parking decals are issued by the Apartment Office. A valid registration card for each vehicle must be presented. The vehicle must be registered to the tenant.
C. No campers, trailers or commercial trucks are allowed to be parked in the apartment lots. Any vehicle remaining in a parking space thirty (30) days without being moved will be towed.
D. Temporary parking permits may be issued for the occasional use of guest at the apartments.
E. During home football games, a housing representative will be in charge of the Faculty and Medical Center parking lots. All persons will need to stop and identify themselves by showing a parking decal or temporary permit. Those individuals without a valid parking decal or temporary permit will not be allowed to park during the football games.
BackSafety Tips
Providing a safe environment for residents of University-owned housing is a primary concern of the Department of University Housing and Apartments. We need the understanding and cooperation of all tenants in ensuring a pleasant and safe living environment. The following represents additional helpful information:
1. Use extreme caution when cooking. Smoke from cooking often activates alarms in the apartment and/or building. Using the kitchen exhaust fan, opening windows, and/or turning the air conditioner on helps to eliminate cooking smoke and/or odors.
2. Extension cords are prohibited if they are not U.L. (Underwriter’s Laboratory) approved.
3. Never leave cooking appliances that are in use unattended.
4. Use only appliances with an U.L. (Underwriter’s Laboratory) seal.
5. Remember that firearms, weapons (BB guns included), fireworks, gasoline flammable liquids, explosives and volatile chemicals or other materials which endanger health and safety are PROHIBITED.
6. Empty cardboard boxes, magazines, trash and/or papers are not permitted to be stored in public areas or any duration of time. The Department of University Housing and Apartments has the right to charge tenants for removing any items from public areas.
7. Sidewalks, porches, public hallways and patios should be cleared of tenant’s belongings. Fire egress must be maintained at all times.
8. Several safety measures should be followed when cooking out of doors. These safety measures are: (a) charcoal or gas grills are not permitted to be used inside the building; (b) grills must be used at least twenty (20) feet away from any building; (c) douse the embers with water before properly disposing of them (marked containers for disposing of charcoal are provided at each building); (d) storing lighting fluid, gasoline, etc, in your apartment or laundry areas is unsafe and in violation of University fire regulations.
Failure to comply with these aforementioned measures may result in fire alarms being activated or worse in actually starting a fire. If tenant negligence activates a fire or fire alarm, he/she will be assessed a damage fee which may include the cost of emergency personnel responding to the call.
It is our hope at the Department of University Housing and Apartments that each tenant will do his or her best to spend a positive and rewarding time in University housing. We would like to do our best in assisting in this effort.
